Board of Trustees Budget Hearing and Regular Meeting
September 6, 2017
The Village of Elmwood Board of Trustees met for the 2017-18 Budget Hearing and in Regular Session on Wednesday, September 6, 2017 at the Elmwood City Hall. Trustees present were Anderson, Baer, Hovick, and Krass with Chairperson Wray presiding. The meeting was called to order at 7:03 p.m. Chairperson Wray stated that a current copy of the Nebraska Open Meetings Act was posted and that additional meeting documents were available. All signed the “Notice of Acknowledgement of Meeting”. A copy of the proof of publication, as well as the Chairman and Trustees’ acknowledgement of receipt of notice, are on file. Notice of the meeting was given in advance thereof by posting in three (3) public places (the Post Office, Village Office, and Elmwood Convenience Store). Minutes were taken by Clerk/Treasurer Connie Carlton.
Motion by Anderson to approve the minutes of the August 16, 2017 Regular Board Meeting as presented, with second by Hovick. RCV: Yes: All. No: None. Motion approved.
PUBLIC COMMENT: Bill Connour passed out brochures and spoke on behalf of EMMA. He noted that EMMA does many projects in the village and would like to see the village consider joining the EMMA organization. It will be discussed at the next board meeting. Trustees Wray, Anderson, and Hovick attended a Cass County Economic Development social in Eagle NE.
PUBLIC BUDGET HEARING – The 2017-18 Budget Hearing was convened at 7:15 p.m. There were a few comments and questions from the public in attendance; all were heard and answered. The public hearing was closed at 7:28 p.m. RESOLUTION NO. 09062017.1 was read by Krass – A RESOLUTION OF THE CHAIRPERSON AND BOARD OF TRUSTEES OF THE VILLAGE OF ELMWOOD, NEBRASKA ESTABLISHING THE PROPERTY TAX REQUEST FOR FISCAL YEAR 2017-2018. Whereas, Nebraska Revised Statute 77-1601.02 provides that the property tax request for the prior year shall be the property tax request for the current year for purposes of the levy set by the County Board of Equalization unless the Board of Trustees of the Village of Elmwood, Nebraska passes by a majority vote a resolution or ordinance setting the tax request at a different amount; and WHEREAS, a special public hearing was held as required by law to hear and consider comments concerning the property tax request; and WHEREAS, it is in the best interests of the Village of Elmwood, Nebraska that the property tax request for the current year be a different amount than the property tax request for the prior year. NOW THEREFORE, the Board of Trustees of the Village of Elmwood, Nebraska by a majority vote resolves that: 1. The 2017-2018 property tax request be set at $160,398.10 which would require a tax rate of $0.487461. 2. A copy of this Resolution be certified and forwarded to the County Clerk on or before September 20, 2017 as part of the Village budget. PASSED AND APPROVED THIS 6th DAY OF SEPTEMBER, 2017. RESOLUTION NO. 09062017.2 was read by Hovick – A RESOLUTION OF THE CHAIRPERSON AND THE VILLAGE OF ELMWOOD, NEBRASKA INCREASING THE RESTRICTED FUNDS LID BY 1% FOR FISCAL YEAR 2017-2018. WHEREAS, pursuant to Neb. Rev. Stat. 13-519, the Village of Elmwood is limited to increasing its total of budgeted restricted funds to no more than the last prior year’s total of budgeted restricted funds plus population growth plus two and one-half percent expressed in dollars; and WHEREAS, State Statute 13-519 authorizes the Village of Elmwood to exceed the foregoing budget limit for a fiscal year by up to an additional one percent increase in budgeted restricted funds upon the affirmative vote of at least 75% of the governing body; and WHEREAS, the Annual Budget for Fiscal Year 2017-2018 in the Lid Computation Fiscal Year 2017-2018 supported by the detail relating to restricted revenue accounts, proposes an additional increase in budgeted restricted funds of one percent as provided by statute; and WHEREAS, approval of the additional one percent increase in budgeted restricted funds is prudent fiscal management, does not increase authorized expenditures, and is in the best interests of the Village of Elmwood and its citizens. NOW, THEREFORE, BE IT RESOLVED BY THE VILLAGE OF ELMWOOD BOARD OF TRUSTEES: THAT upon affirmative vote by more than 75% of the Village Board, the budgeted restricted funds for Fiscal Year 2017-2018 shall be increased by an additional one percent as provided by Neb. Rev. Statute 13-519. PASSED AND APPROVED THIS 6TH DAY OF SEPTEMBER, 2017. Motion by Krass to approve Resolution No. 09062017.2 as read with second by Anderson. VOTE: Yes – Hovick, Anderson, Krass, Baer, Wray; No – None. Motion approved. RESOLUTION NO. 09062017.3 was read by Anderson – A RESOLUTION TO ADOPT THE BUDGET FOR FISCAL YEAR 2017-2018. BE IT RESOLVED by the Chairperson and Board of Trustees of the Village of Elmwood, Cass County, Nebraska: WHEREAS, a proposed Budget for the Fiscal Year beginning October 1, 2017 through September 30, 2018, was provided to the Village Board on the 6th day of September, 2017. NOW THEREFORE, the Governing Body of the Village of Elmwood, Nebraska, by a majority vote, resolves that: The Budget for the Fiscal Year beginning October 1, 2017 through September 30, 2018 is hereby adopted as the Budget for the Village of Elmwood, Nebraska for said fiscal year. PASSED AND APPROVED THIS 6TH DAY OF SEPTEMBER, 2017. Motion by Hovick to approve Resolution No. 09062017.3 as read with second by Baer. VOTE: Yes – Baer, Anderson, Hovick, Krass, Wray. No – None. Motion approved. ORDINANCE NO. 2017-016 was read by Baer – AN ORDINANCE TO ADOPT THE BUDGET STATEMENT TO BE TERMED THE ANNUAL APPROPRIATION BILL: TO APPROPRIATE SUMS FOR NECESSARY EXPENSES AND LIABILITIES; TO PROVIDE FOR AN EFFECTIVE DATE. BE IT ORDAINED BY THE CHAIRPERSON AND BOARD OF TRUSTEES OF THE VILLAGE OF ELMWOOD, NEBRASKA: SECTION 1. That after complying with all procedures required by law, the budget presented and set forth in the budget statement is hereby approved as the Annual Appropriation Bill for the fiscal year beginning October 1, 2017 through September 30, 2018. All sums of money contained in the budget statement are hereby appropriated for the necessary expenses and liabilities of the Village of Elmwood, Nebraska. A copy of the budget document shall be forwarded as provided by law to the Auditor of Public Accounts, State Capitol, Lincoln, NE and to the County Clerk of Cass County, Nebraska for use by the levying authority. SECTION 2. This Ordinance shall take effect and be in full force from and after its passage, approval, and publication or posting by law. PASSED AND ADOPTED THIS 6TH DAY OF SEPTEMBER, 2017. REPORTS OF BOARDS, COMMISSIONS, AND COMMITTEES: Streets: Potholes on East D and Railroad Ave near the bridge were discussed. Ed will temporarily patch, and estimates for a permanent fix will be obtained. Park: Bubble Soccer on Sunday, September 10; Harvest Moon Hustle to be held Friday, September 15. Library: Motion by Krass to approve the library A/P report as presented with second by Hovick. RCV: Yes: All, No: None. Motion approved. Water: August water rate study – Pumped 2,322,000 gal.; Treated 2,149,000 gal.; Wasted R/O 173,000 gal.; Average daily usage 74,000 gal.; Average nitrates 5.8. There was a water leak at 328 East C Street requiring replacement of a bad valve. Sewer: The jet pump has been installed; will be wired in a few days. A 24-hr composite test was delivered to Waverly NE. Jetting of mains to be completed this week by Ak-Sar-Ben Pipe & Sewer Cleaning.
Unfinished Business: Matt Jarvis with the Cass County Sheriffs Dept discussed different ways the Neighborhood Watch program could be organized and ways in which it could be utilized. An organizational meeting will be held in about a month.
New Business: Discussion was held in regard to moving one board meeting per month to the Elmwood Community Center. It was decided to hold the first Wednesday meeting of the Board at the Center beginning on October 4th.
